ANJANA MISHRA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 1.8.2016 in connection with Turkaulia P.S. Case No.391 of 2014 registered for the offences under Sections 364 and 384/34 of the Indian Penal Code.

Diary in the present case was called for, which has since been received.

After hearing the learned counsel for the petitioner and the learned counsel for the State and on perusal of the case diary, it appears that the petitioner and informant's side are close brothers and that the victim boy has been recovered after lapse of three days after lodging of the case. The petitioner alleged

Patna High Court Cr.Misc. No.44365 of 2016 (3) dt.24-11-2016 2/2 that it is a case of false implication as the informant's side had been asked to part with the land in pursuance of a Panchayati. In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 8th Additional Sessions Judge, East Champaran, Motihari, in connection with Turkaulia P.S. Case No.391 of 2014.
