JUSTICE SANJAY PRIYA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Teghra P.S. Case No. 145 of 2016 instituted for the offence under Sections 448, 341, 323, 307, 504 and 379/34 of the Indian Penal Code. There is specific allegation against the petitioner of assaulting Rekha Devi with Khanti on the head. The injury report of Rekha Devi is annexed as Annexure 3 wherein doctor has found after X-ray of the skull injuries on her head grievous in nature. It has been submitted on behalf of the petitioner that a compromise has taken place between the parties. This Court is of the view that this ground may be taken for regular bail and not for anticipatory bail.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.10090 of 2017 (2) dt.10-03-2017 2/2 this Court is not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail of the petitioner stands rejected.

The petitioner is directed to surrender before the court below and pray for regular bail which shall be disposed off by the court below in accordance with law on the same day without being prejudiced by this order.
