JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Kahalgaon P.S. Case No. 412 of 2014 registered for the offences punishable under sections 302 read with 34 of the Indian Penal Code and 27 of the Arms Act.

It has been contended that though the petitioner is named in the F.I.R. but on the relevant date and time of occurrence he was not present at the place of occurrence. As a matter of fact, he had gone to Malda, West Bengal in order to deposit tuition fee of his son, who is a student of Kishalaya School at Bolpur in West Bengal.

Learned counsel for the State has opposed the prayer

Patna High Court Cr.Misc. No.46465 of 2014 (2) dt.10-04-2015 2/2 for bail. He has stated that the petitioner is one of the five miscreants named in the F.I.R. The miscreants are alleged to have killed one Pappu Khan.

Be that as it may, regard being had to the serious nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected.
