Petitioner seeks bail in Pandarak P.S. Case No.128 of 2016 instituted for the offence under Section(s) 302/34 Indian Penal Code.
Counsel for the petitioner submits that there is general and omnibus allegation against the petitioner. The petitioner has been made accused merely on hearsay statement given by informant in the written report.
It is further submitted that the other co-accused with similar allegations have already been granted regular bail vide order dated 13.02.2018 and 18.10.2017 passed by this Court in Cr. Misc. No.60476 of 2017 and 50579 of 2017 respectively.
Patna High Court Cr.Misc. No.67277 of 2018(2) dt.26-11-2018 2/2 In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Barh, Patna, in connection with Pandarak P.S. Case No.128 of 2016, subject to the condition that both the bailors shall be close relative of the petitioner.
