The petitioner is apprehending arrest in connection with Bheja P.S. Case No. 54 of 2016 for offences under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that the petitioner has no criminal antecedent. Referring to the FIR he submits that the petitioner is only a member of mob. After investigation the police submitted final form and thereafter on complain before the DIG direction was issued for further investigation under Section 73(8) Cr.P.C.
Learned counsel for the informant submits that after submission of the final form a complaint was made to the
Patna High Court Cr.Misc. No.68223 of 2018(2) dt.14-12-2018 2/2 DIG and thereafter direction was issued for further investigation in terms of Section 73(8) Cr.P.C. and after investigation materials have come against the petitioner.
Considering the fact that in the FIR the role attributed to the petitioner is only that he was a member of mob and no other overt act, let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate III, Jhanjharpur, Madhubani in connection with Bheja P.S. Case No. 54 of 2016, subject to the conditions as laid down under Section 438(2) Cr. P. C.
