Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Sitamarhi P. S. Case No.725 of 2020, instituted for the offences under Sections 414, 420, 120(b) of the Indian Penal Code and Section 30(a)/ 36/ 41(1) of the Bihar Prohibition and Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 25.12.2020 and he is a person with clean antecedent, charge-sheet has been submitted. 17.280 litres of foreign wine is alleged to have been recovered from the petitioner, but from perusal of the allegation

Patna High Court CR. MISC. No.31120 of 2021(2) dt.25-11-2021 2/2 as alleged in the F.I.R., the total recovery from different accused amounts to 203.280 litres.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 25.12.2020 and he is a person with clean antecedent, charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II- cum- Special Judge, Excise Act, Sitamarhi in connection with Sitamarhi P. S. Case No.725 of 2020.

The application stands allowed.
