2. The petitioner has prayed for bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.
3. As per prosecution case, while the informant came out of the clothes shop after buying clothes then two unknown miscreants boarded on black motorcycle came very furiously and snatched the cash bag containing Rs. 40,000/-, bank passbook, pan card, Adhar card and mobile form the informant and fled away towards Dheydi Ghat.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this
Patna High Court CR. MISC. No.23152 of 2023(6) dt.19-12-2023 2/2 case due to dirty village politics. Neither the petitioner is named in the F.I.R. nor put on T.I.P. Nothing has been recovered from his conscious possession. During investigation, no consistent material has come against the petitioner to show his complicity in the present occurrence. Petitioner is languishing in judicial custody since 06.12.2022.
5. The application for bail is opposed by learned APP for the State and submitted that petitioner has twelve criminal antecedents .
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail after framing of charge, if not framed. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M., Saran at Chapra or concern Court, Saran at Chapra in connection with Baniyapur P.S.
