In this case, the petitioner is apprehending his arrest in connection with Mahila P.S. Case No. 96 of 2016 registered for offences under sections 376, 323, 504, 506/34 of the Indian Penal Code.

An allegation has been made against the petitioner that the victim had gone to attend the call of nature, the petitioner came there and committed rape upon her.

Looking to the entire fact and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the

Patna High Court Cr.Misc. No.19592 of 2017 (3) dt.06-07-2017 petitioner, namely, Suman Choudhary @ Suman Kumar Choudhary is rejected.
