JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and the dead body of the deceased was disposed of in hurried manner. The father-in-law of the deceased appears to have given wrong information to the informant regarding missing of the deceased. However, in course of investigation, the informant and some witnesses stated that deceased was killed due to non fulfillment of illegal demand whereas some witnesses stated that the deceased was taken to hospital but she died on her way. Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the

Patna High Court Cr.Misc. No.45587 of 2016 (3) dt.01-12-2016 2/2 petitioner on bail and, hence, his prayer for bail in connection with Balthar P.S.Case No. 20 of 2016, pending in the court of learned Judicial Magistrate, 1st class, Bettiah, West Champaran stands rejected.

However, if the trial of the petitioner is not concluded within six months from the date of receipt/ production of a copy of this order, the petitioner may renew his prayer for bail before the learned trial court itself.
