ANJANA MISHRA ORAL ORDER 16-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 24.7.2014 in Ghorasahan P.S.Case No.254/14 for the offences under Sections 363, 366(A), 342,34 of the I.P.C.

It is submitted on behalf of the petitioner that he has been falsely implicated in the present case as the victim girl herself in her statement made under Section 164 Cr.P.C. has categorically stated that she had not been kidnapped by any one rather she had gone to the house of her uncle and aunt on her own sweet will and repeatedly requested them to inform her parents about her arrival but they did not take pain to inform her parents upon which, she without informing her uncle and aunt,appeared at the police station. She has also stated in her statement

Patna High Court Cr.Misc. No.46561 of 2014 (2) dt.16-02-2015 2/2 under Section 164 Cr.P.C. that she had not been kidnapped by any one.

Considering the aforesaid submissions and the period of custody and also the fact that there is no criminal antecedent against this petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Sikrahana, in Ghorasahan P.S.
