Petitioner seeks bail in a case registered under section 379 of the Indian Penal Code.

Petitioner is not named in the first information report but after institution of the FIR, petitioner and one co- accused were caught with stolen motorcycle and at the time of recovery, stolen motorcycle was being driven by co- accused Deepak Kumar Srivastava whereas petitioner is pillion rider.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Rafiganj P.S.
