JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 This is an application for grant of anticipatory bail in connection with Bodh Gaaya P.S. Case No. 315 of 2018, disclosing offences under Sections 406, 409, 419, 420, 465, 467, 471, 34 of the Indian Penal Code.

Prosecution story is that petitioner has taken housing loan worth Rs. 5,00,000/- from the State Bank of India in the name of Nawlesh Singh and thereafter, same has become N.P.A. and later on Bank authority came to know that petitioner has taken the said loan by forged documents.

After some arguments, learned counsel for the petitioner has submitted that he is ready to pay back the said amount on reasonable installments.

Heard learned A.P.P. as well as learned senior counsel appearing on behalf of the State Bank of India also.

No.20957 of 2019(3) dt.20-06-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, this application is disposed of with the direction to the petitioner to surrender before the court below within a period of eight weeks and to pay a sum of Rs. 1,54,000/- (one lakh fifty four thousand) by bank draft in favour of the State Bank of India and in the meantime, the SBI shall calculate the actual dues against the petitioner including the accrued interest and the petitioner has to deposit the rest of the amount and accrued interest within a further period of four months in four equal installments. Once the whole amount is deposited by the petitioner, the bail bonds of the petitioner shall be confirmed. Needless to say in failure to deposit the whole amount within the period, prescribed above, bail bond of the petitioner shall be cancelled.
