Learned counsel for the petitioner is directed to remove the defects as pointed out by the office, within four weeks. In the eventuality of non-removal of defects within stipulated period, the office will place the matter before the Bench. After some arguments, learned counsel appearing for the petitioner seeks permission to withdraw this application with a liberty to seek regular bail before the learned court below. It is also submitted that the petitioner has been given the privilege of section 41(A) of the CrPC.

Prayer is allowed.

The instant application is dismissed as withdrawn. However, the petitioner is directed to surrender before the

Patna High Court CR. MISC. No.30112 of 2021(2) dt.03-01-2022 2/2 learned court below within a period of four weeks and seek regular bail.

The learned court below is directed to consider and dispose of the case of the petitioner, preferably, on the same date in accordance with the merits of the case without being prejudiced by the withdrawal of the present application, keeping in view that the petitioner has been given the privilege of section 41(A) of the Cr.P.C.
