The petitioner seeks regular bail in connection with Raushanganj P.S. Case No. 182 of 2018 for the offences punishable under Sections 25(1-b)a/26/35 of the Arms Act. The allegation is regarding the police patrolling party having apprehended the accused persons including the petitioner herein and upon search being made, one country made sixer pistol having wooden butt was recovered from the petitioner. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he is having a clean antecedent and is languishing in custody since 14.12.2018.

Having regard to the facts and circumstances of the

Patna High Court CR. MISC. No. 19028 of 2019(2) dt.04-04-2019 2/2 case, I deem it fit and proper to direct for release of the petitioner immediately upon completion of six months of his custody i.e. w.e.f. 14.12.2018 subject to such condition as may be imposed by the learned court of A.C.J.M., Shergthati (Gaya) in connection with Raushangaj (Bankey Bazar) P.S. Case No. 182 of 2018.

The petition stands disposed of with the aforesaid directions.
