JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially, registered for the offences punishable under Section 394 of the Indian Penal Code and subsequently, Section 395 of the Indian Penal Code was added.

Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 21.06.2016 passed in Cr. Misc. No. 25561 of 2016 taking note of criminal antecedent of petitioner but submission on behalf of the petitioner is that coaccused, Prince Kumar and Gaurab Kumar Jha, having similar allegation, have already been granted privilege of bail by a coordinate Bench of this court and so far as petitioner is concerned,

Patna High Court Cr.Misc. No.45060 of 2016 (3) dt.16-11-2016 2/2 neither he is named nor has been put on Test Identification Parade nor anything has been recovered from his conscious possession and except confessional statement as well as criminal antecedent, there is nothing against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI, Barh, Patna in connection with Sessions Trial No. 352 of 2016 arising out of Bakhtiyarpur P.S. Case No. 179 of 2015.
