Petitioner, who is in custody, seeks bail in connection with Pandarak P.S. Case No. 87 of 2018 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Allegation against petitioner is of recovery of 208 liters country made foreign liquor from the vehicle of the petitioner, when he started fleeing away on seeing the police. Two co-accused managed to escape however petitioner was apprehended on the spot.

It has been submitted on behalf of the petitioner that petitioner has been falsely implicated in this case and he was not sitting in the vehicle and was arrested by the police on

Patna High Court Cr.Misc. No.67545 of 2018(2) dt.27-11-2018 2/2 suspicion only. Petitioner has no criminal antecedent and is in custody since 07.09.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of special Judge, Excise, Patna, in connection with Pandarak P.S. Case No. 87 of 2018.
