JUSTICE ALOK KUMAR SINHA ORAL ORDER 12-05-2026 Heard learned counsel for the petitioners and the learned counsel appearing for the respondent-State. 2 With consent of the parties, this writ petition is being disposed of at this stage itself.

3 The petitioners, in the present writ petition, have prayed for the grant of the following relies: "i For issuance of an appropriate writ in the nature of mandamus commanding and directing the respondents authorities for fixation of salary of the petitioners in the trained graduate pay scale in view of the provision contained in Rule 22

(1) (A), 7 (i) (ii) (iii) and (iv) of the fundamental

2/4 rules which inter alia provides that for the purpose of pay fixation on promotion, the salary payable on the date of promotion would be fixed and thereafter pay fixation would be done after giving benefits of one additional increment of the existing pay scale and to pay arrears of salary of the petitioners after aforesaid fixation from the date when they have been granted trained graduate pay scale by the respondent authorities.

ii To further direct the respondent authorities as per promotion rule 2011 (Rule 10) to grant promotion into graduate Trained Scale as well as on the post of headmaster to the petitioners with effect from 31.01.2014 and their consequential benefits.

iii For issuance of any other appropriate writ (s), order (s), directions (s) for which the writ petitioners would be found entitled under the facts and circumstances of the case.

iv And/or any other appropriate reliefs to the petitioners for which the petitioners may be found entitled under the facts and circumstances of the case."

4 After advancing some argument, learned counsel appearing appearing for the petitioners submits that although the petitioners have filed several representations in the past, the petitioners shall once again submit a fresh representation before the District Education Officer, Khagaria and prays that an appropriate direction be issued to the District Education Officer, Khagaria to entertain the representation of the petitioners and dispose of the same within a fixed time after giving an opportunity of hearing to the petitioners.

3/4 5 Learned counsel appearing for the respondent-State has no objection to the submission made by the learned counsel for the petitioners.

6 Considering the limited nature of prayer made by the learned counsel for the petitioners, this writ petition is disposed of granting the liberty to the petitioners to file a fresh representation before the District Education Officer, Khagaria within four weeks from the date of this order. 7 If such representation is filed within the stipulated time, the District Education Officer, Khagaria shall entertain and dispose of the same within a period of five months from the date of receipt of the representation, after giving an opportunity of hearing to the petitioners.

8 Needless to emphasize that the final order, which shall be passed by the District Education Officer, Khagaria, should be a reasoned and speaking order and if the petitioners are found entitled to the relief which the petitioners would be claiming through the representation, the same should be extended to them within a further period of one month from the date of passing of the final order.

9 With the aforesaid observation, direction and liberty granted, the present writ petition is disposed of.
