The petitioner is an accused in connection with Sanokhar P.S. Case No. 94 of 2016, registered under Sections 392 and 411 of Indian Penal Code, pending in the Court of Chief Judicial Magistrate, Bhagalpur.
The accusation is that on 14.11.2016, one Chandan Yadav hired Scorpio vehicle of the informant for going to railway station, Bhagalpur in which Chandan Yadav, Md. Rahman (Petitioner) and one Dinbandhu Sharma boarded on the said vehicle. In course of returning from the railway station, in the way, all of them got down from the vehicle and at that time petitioner and Chandan Yadav pointed pistol on him and moved with the Scorpio. After some time, the vehicle of the informant was recovered by the Police. Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.16737 of 2017 (3) dt.10-05-2017 2/2 submits that petitioner has not been apprehended on the spot with the stolen vehicle and he has falsely been implicated in this case. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected for the present.
