The petitioner apprehends his arrest in Bheldi P.S. Case No. 104 of 2016 instituted for the offence under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. From the written report, it appears that there is specific allegation against this petitioner of assaulting with Hasua on the head of wife of the informant causing bleeding injury. The injury report has been annexed as Annexure-3, wherein doctor has found lacerated wound on scalp beside other injuries. Although after C.T. Scan doctor has described aforesaid injuries simple in nature but since there is specific allegation against this petitioner of assaulting with Hasua on the head of wife of the

Patna High Court Cr.Misc. No.5146 of 2017 (3) dt.16-02-2017 2/2 informant, this court is not inclined to grant the petitioner anticipatory bail. Accordingly, this anticipatory bail petition is hereby rejected.

The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail which shall be disposed of in accordance with law preferably on the same day after looking to the fact that the nature of injuries as described by the doctor are simple.
