This is an application for grant of regular bail for offences punishable under Sections 47(a) and 53(a) of the Bihar Excise (Amendment Act) 2016.

It has been submitted on behalf of the petitioner that 20.7 ltr. of Nepali Saufi Wine is recovered from the possession of the petitioners and there is no criminal antecedent against these petitioners and they are in custody for more than 4 months and they are ready to abide any condition imposed on them. Heard learned A.P.P. Also.

Considering the facts and circumstances of the case and also the fact that the petitioners have no criminal antecedent and they have remained in judicial custody for about four months, let both

Patna High Court Cr.Misc. No.54258 of 2016 (3) dt.11-01-2017 2/2 the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Complaint Case No.C2/241/16.
