NILU AGRAWAL ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner is languishing in custody since 22.07.2016 in connection with Sangrampur P.S. Case No. 73/16 for offences punishable under Section 392 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that while he was returning to his house few miscreants snatched the keys of his motorcycle, took away the same and also assaulted him.
It has been submitted by the learned counsel for the petitioner that he is innocent, no Test Identification Parade has been done so far and that on his
Patna High Court Cr.Misc. No.52377 of 2016 (2) dt.16-12-2016 2/3 confessional statement in the earlier case he has been made accused in the present case. It is submitted that the chargesheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence and another coaccused has since been granted the privilege of bail by a Coordinate Bench of this Court in Cr. Misc. No. 51079 of 2016 on 28.11.2016.
However, learned APP for the State opposes the prayer for bail.
Be that as it may, since charge-sheet has already been submitted, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Sangrampur P.S. Case No. 73/16.
This direction of bail is, however, subject to the condition that one of the bailors should be the close relative of the petitioner and the other bailor should have sufficient immovable property within the jurisdiction of the concerned police station/ court and that the petitioner will appear before the learned court below on each and every
Patna High Court Cr.Misc. No.52377 of 2016 (2) dt.16-12-2016 3/3 date and failure to appear on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
