JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 02-09-2015 The present application has been filed for modification of order dated 07.04.2015 passed in Cr. Misc. No. 14115 of 2015 for extending the period of provisional bail. The petitioner was granted provisional bail for four months in connection with Chenari P.S. Case No. 203 of 2013 registered under Section 409 of the Indian Penal Code, pending in the court of learned Judicial Magistrate, Ist Class, Sasaram (Rohtas).

The petitioner undertook to deposit Rs.1,07,500/- before the learned court below which was to be invested in some fixed deposit scheme in connection with the present case which will be subject to the result of the present case. It is submitted by learned counsel for the petitioner that the petitioner filed petition on 04.08.2015 for

Patna High Court Cr.Misc. No.41084 of 2015 (2) dt.02-09-2015 2/2 deposit of the above amount but no order has been passed on the said application.

In the circumstances, the period of provisional bail is extended by six weeks.

In the meantime, let the learned court below accept the deposit of the petitioner. On deposit of the alleged amount of Rs.1,07,500/- the provisional bail will be confirmed by the learned court below.

The order dated 07.04.2015 stands modified to the extent indicated above.

Accordingly, this modification application is disposed of.
