Mr. Sri Narsingh Tanti ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-12-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with G.R. No. 627 of 2018, arising out of Rohtas P.S. Case No.168 of 2018 for the offence under Sections 379, 411 /34 of the Indian Penal Code and Section 40 (1) of Bihar Mines and Minerals Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He is owner of the JCB which is allegedly used for excavating the sand. He further submits that petitioner was not aware of the fact that JCB of the petitioner was used for such activities. He submits that petitioner shall be cautious in the use of JCB in future. If it is reported that his JCB used for any illegal activity his bail bond

Patna High Court Cr.Misc. No.68285 of 2018(2) dt.14-12-2018 2/2 shall be cancelled by the Court below.

Considering the undertaking and fact that the petitioner has no criminal antecedent, let the petitioner above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Court of learned Judicial Magistrate Cum Additional Munsif Dehri, District- Rhotas in connection with G.R. No. 627 of 2018, arsing out of Rohtas P.S. Case No. 168 of 2018 subject to the conditions as laid down under Section 438 Cr.P.C. as also with condition that in future it is reported that the JCB is found in illegal mining of sand, the Court below shall at liberty to cancel the bail bond of the petitioner.
