Petitioner seeks bail in a case registered under sections 272 273, 290/34 of the Indian Penal Code and various sections of the Excise Act.

According to the prosecution case itself, alleged recovery was made from the hut of Bhutali Mukhiya and Vaiyas Mukhiya. So far as the petitioner is concerned, he as well as some others were caught near the aforesaid hut. Co- accused Mangni Paswan has already been granted privilege of bail by a coordinate bench of this court vide order dated 5.10.2016 passed in Cr. Misc. no. 44222/2016 and the case of the petitioner is similar footing to that of co- accused. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri N.P. Singh, Judicial Magistrate, Ist Class, Bettiah, West Champaran in Sathi P.S. Case no. 111/2016. shahid (Hemant Kumar Srivastava,J) U T
