====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 26-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bhangaha P.S. Case No. 65 of 2021 lodged under Sections 20, 22, 23, 24 and 27 of the N.D.P.S. Act.

As per the prosecution, the allegation upon the petitioner is that he was coming from Nepal and upon secret information, police party has caught him and from his possession 02 kg. Ganja has been recovered from a polythene on his bike.

Learned counsel for the petitioner submits that petitioner has clean antecedent, he is in custody since 07.10.2021 and charge sheet has already been filed in this case. He further submits that petitioner is ready to file any surety, any

Patna High Court CR. MISC. No.21835 of 2022(2) dt.26-07-2022 2/2 undertaking, any affidavit whatsoever it may be that he shall not commit any offence of this type while on bail. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bettiah, West Champaran in connection with Bhangaha P.S. Case No. 65 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. The petitioner is directed to file an affidavit before the Court below at the time of furnishing the bail bonds that he shall not involve in such type of activities again and also appear before the Trial Court on each and every date, in case of nonappearance for two consecutive dates, shall resulted into cancellation of his bail bond.
