The petitioner apprehends his arrest in a case under Sections 406, 417, 420, 424, 506, 120(B) of the Indian Penal Code.

The informant alleged that the petitioner was driver of his Bolero Jeep bearing registration no. BR-06-PB-5093. The petitioner took the aforesaid vehicle on hire on 03.06.2015 but he did not return the vehicle for more than a month. When the informant enquired about his vehicle, he did not give any satisfactory reply about the whereabouts of the vehicle. Learned counsel for the petitioner submits that from perusal of Annexure-2, it would appear that the vehicle was stolen. The petitioner informed the police but the police did not lodge the case. On the other hand, learned counsel for the informant submits

Patna High Court Cr.Misc. No.40964 of 2015 (2) dt.06-10-2015 2/2 that Annexure-2 does not appear to be genuine. It does not bear any seal or signature of the SHO, Hajipur. No F.I.R. was lodged on the statement of the petitioner.

Considering the facts that the petitioner was entrusted with the vehicle to ply on road on hire basis but the petitioner did not give satisfactory reply and the vehicle is still missing, I am not inclined to enlarge the petitioner on anticipatory bail in Madhuban P.S. Case No. 182 of 2015. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Dilip/- U T
