Petitioners seek bail in Koilwar P.S. Case No.20 of 2019 instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioners submits that petitioners have been arrested merely on suspicion.
In the written report, it is alleged that police got information that some persons are making illicit liquor. The police went at the place of occurrence. After seeing the police, owner of Bhathi began to run away. The police arrested three persons (petitioners) and other three persons managed to run

Counsel for the petitioners submits that petitioners have no concern with aforesaid Bhathi. They were working in nearby field as they are farmers. They have been arrested merely on suspicion. Real miscreants have managed to run away. Petitioners are in custody since 27.01.2019 having clean antecedents.
In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the 4th Additional Sessions Judge cum Special Judge, Excise, Bhojpur, Ara, in connection with Koilwar P.S. Case No.20 of 2019, subject to the condition that both the bailors shall be close relative of the petitioners.
