2. Learned counsel Mr. Nikesh Kumar accepts notice for respondent Nos. 2 and 3.

3. Service of notice to respondent No. 1 is dispensed since 1st respondent is not a necessary and proper party.

4. In the instant petition, petitioners have prayed for the following relief/reliefs:

"That this petition in the form of mandamus is being filed for commanding and directing upon the concerned Respondents to grant A.C.P. in number as every petition is entitled as per period of service and pay the benefits accrued after granting promotion to the petitioners."

5. In support of the aforesaid relief, petitioners submitted representations/applications vide Annexures 4 and 5 respectively. Therefore, respondent No. 3 - The Chief Executive Officer-cum-Deputy Development Commissioner, Zila Parishad,

Patna High Court CWJC No.9746 of 2021 dt.18-02-2022 3/3 Aurangabad is hereby directed to pass a speaking order as to whether petitioners are entitled to A.C.P. benefits or not? If they are entitled, in that event, necessary order shall be passed while extending monetary benefits. If they are otherwise not entitled, in that event, necessary speaking order shall be passed and communicated to the petitioners.

6. The above exercise shall be completed within a period of three months from the date of receipt of this order.
