NILU AGRAWAL ORAL ORDER 26-11-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 26.06.2016 in a case registered for the offences punishable under Sections 147, 148, 149, 342, 323, 324, 307, 379 and 427 of the Indian Penal Code.
Allegation against the petitioner is that against the petitioner is that he along with other accused persons had assaulted the informant and his family members with lathi, danda and rod etc.
It has been submitted by the learned counsel for the petitioner that charge sheet has already been submitted against him and that he has no criminal history. He submits that there is no allegation of tampering with the witnesses and the injury found on
Patna High Court Cr.Misc. No.45223 of 2016 (3) dt.26-11-2016 2/2 the informant and his family members were simple in nature. He further submits that two of the co-accused have already been granted the privilege of bail by a Co-ordinate Bench of the Court in Cr. Misc. No. 42283 of 2016 dated 03.10.2016 and Cr. Misc. No. 38479 of 2016 dated 11.11.2016 on similar allegations. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge 5th -CumAdditional Chief Judicial Magistrate, Muzaffarpur in connection with Pear P.S. Case No. 61 of 2010.
