22-08-2016 Sri Uma Kant Shukla, learned counsel assisted by Sri Pathak Dhananjay Kumar, learned counsel for the petitioner as well as Sri Milind Kumar Mishra, learned counsel for complainant/opposite party no. 2 jointly submit that in view of mediation, dispute in between the parties has already been settled. The report of the Mediator has been kept on record. The report dated 16-05-2016 suggests that after the dispute was settled, the opposite party no. 2/complainant had agreed to withdraw the complaint case.
Learned counsel for the complainant/opposite party no. 2, in view of Mediator's report, makes a prayer for disposal of
Patna High Court Cr.Misc. No.28496 of 2013 (7) dt.22-08-2016 2/2 the petition so that complainant/opposite party no. 2 may file a petition before the court below and make a prayer for withdrawal of the case.
The prayer is allowed.
The petition stands disposed of.
If such petition is filed by opposite party no. 2 within a period of four weeks from today, the Court expects that learned court below, after filing of the petition, may take final decision within a period of two weeks thereafter.
