JUSTICE SANDEEP KUMAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioner, learned senior counsel for the D.R.I. and learned Additional Public Prosecutor appearing on behalf of the State.

The petitioner seeks regular bail in connection with Complaint Case No. 376 (O)/2022, arising out of DRI, Patna Unit Case No. 23/2022-23, registered for the offence punishable under Sections 135 (1) (b) of the Customs Act, 1962. Learned counsel for the petitioner has submitted that from the possession of the petitioner, total 2680.600 grams of gold bullion of foreign origin worth Rs. 1.48 crores was recovered. The petitioner has confessed that he is the carrier of the gold and he was carrying it for co-accused Kailash Chandra of Meerut.

Patna High Court CR. MISC. No.23457 of 2023(2) dt.22-05-2023 2/2 Learned counsel for the D.R.I. has submitted that gold is of foreign origin and it was smuggled by the petitioner for Kailash Chandra. Counter affidavit has been filed by the D.R.I. is taken on record.

Learned APP has vehemently opposed the prayer for bail.

Considering the submission of the parties and the fact that petitioner is a carrier of the gold and he is in custody since 20.12.2022, this application is allowed.

Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Economic Offence, Patna in connection with Complaint Case No. 376 (O)/2022, arising out of DRI, Patna Unit Case No. 23/2022-23.

The court below before releasing the petitioner will verify the address of the petitioner. One of the bailors shall be close relative of the petitioner.
