JUSTICE SANJAY PRIYA ORAL ORDER 01-04-2019 Heard learned counsel for the petitioner, learned counsel for informant and the learned APP for the State. The petitioner seeks bail in connection with Ballia P.S. Case No. 270 of 2013 instituted for the offence under Section(s) 147/148/149/326/307/302/504 of Indian Penal Code and Section 27 of Arms Act.

Learned counsel for petitioner has submitted that petitioner is merely an order giver.

It is alleged in the written report that on the order of this petitioner Raushan Singh made firing on the chest of brother of the informant on account of which he died. Learned counsel for informant has submitted that petitioner has criminal antecedent also.

Petitioner is in custody since 05.11.2018 Keeping in view the period of custody and the fact that petitioner is only an order giver, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 270 of 2013, subject to the following conditions;

(i) Both the bailors shall be the close relative of the petitioner.

(ii) The petitioner shall be present on each and every date fixed by the Court and absence on two consecutive dates without valid reason will result in cancellation of bail bond of the petitioner.
