The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.

The petitioner apprehends his arrest in connection with Complaint Case No. 957 of 2019 registered for offence punishable under sections 406, 409, 420 of the Indian Penal Code.

No.31663 of 2021(2) dt.01-02-2022 2/3 The learned counsel for the petitioner has submitted that the complainant filed the complaint petition on 16.04.2019, alleging therein that the petitioner has taken clothes from the firm of the complainant from 17.05.2010 to 31.05.2010, but he did not pay the entire consideration amount and only part payment was done.

The learned counsel for the petitioner has submitted that the entire consideration amount was paid to the complainant. At the same time, he has also submitted that the complaint case has been filed after lapse of nine years. Considering the above mentioned facts and circumstances, the dispute appears to be of civil nature. Accordingly, let the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Complaint Case No. 957 of 2019, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this
