The petitioner seeks bail in connection with Pirbahore P.S. Case No. 339 of 2018, G.R. No. 3897 of 2018 instituted for the offence under Section(s) 380, 411 and 413 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that F.I.R. is against unknown. The name of this petitioner has come in the confessional statement of co accused Raja Thakur from whose house some articles were alleged to have been recovered . It is further alleged that house of this petitioner was also searched and few utensils were recovered from possession of this petitioner as mentioned in the seizure list, which is part of the FIR.
Patna High Court Cr.Misc. No.67778 of 2018(2) dt.26-11-2018 2/2 Learned counsel for the petitioner has submitted that all those articles are common house hold articles found in every house.
The petitioner is in custody since 18.6.2018 having no criminal antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Pirbahore P.S. Case No. 339 of 2018, G.R. No. 3897 of 2018,subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U
