JUSTICE SUDHIR SINGH ORAL ORDER 20-11-2017 It has been submitted by the office that the original file of the present writ application was misplaced. Hence, the office has taken steps for reconstructing the file by taking the second copy of the brief from the learned counsel for the petitioner. Since the file has already been reconstructed, no further order is required to be passed in respect to the same. Learned counsel for the petitioner seeks permission to withdraw the present application with liberty to prefer an appeal before the State Appellate Authority against the order dated 30.06.2011 passed in Case No.129/2011 by the District Teachers Employment Appellate Authority, Nawada.

Permission is accorded.

Patna High Court CWJC No.16153 of 2011(3) dt.20-11-2017 2/2 The petitioner shall file an appeal before the State Appellate Authority within a period of thirty days and the same shall be disposed of within the statutory period. It has further been pointed out on behalf of the petitioner that the petitioner was granted interim protection vide order dated 20.09.2011.

The petitioner will be at liberty to make a separate application before the State Appellate Authority during the pendency of the appeal within a period of ten days from the date of filing of the appeal and the same shall be disposed of within a period of twenty days from the date of filing of such application. With the aforesaid observation and direction, the present writ application stands disposed of.
