JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 The petitioner seeks regular bail in connection with Nawanagar (Basudewa) P.S. Case No. 75 of 2018, registered for offences punishable under Sections 147, 148, 149, 341, 302 and 120(b) of the Indian Penal Code.

Allegation against the petitioner and other accused persons is of assault to the father-in-law of the informant by lathi, danda, bricks and stones and causing his death. Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner. Further submission is that 8 persons have been named in the F.I.R. and 3 injuries were found on the body of the deceased. Moreover, other accused person having similar allegation has already been granted bail by a Coordinate Bench of this Court vide order dated 01.11.2018 passed in Cr. Misc.

Patna High Court Cr.Misc. No.66826 of 2018(2) dt.26-11-2018 2/2 No. 58265 of 2018 and the petitioner is in judicial custody since 21.06.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Nawanagar (Basudewa) P.S. Case No. 75 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
