JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 341, 323, 307, 302, 427, 504 and 506 of the Indian Penal Code and 27 of the Arms Act. Allegation is that due to land dispute petitioner along with a number of accused persons came and assaulted by fire arms upon Md. Sageer Ali who died in course of treatment. Rs. 80,000/- was snatched by one of the accused from one shopkeeper, namely, Azad Ali.
It has been submitted on behalf of petitioner that he is in custody since 25.9.2016. He has got no criminal antecedent. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. It is a case and counter case between the parties. Petitioner is said to have caused injury on the uncle of the informant. No injury is attributed against him as far as the deceased is concerned. The main allegation has been made for causing injury upon the deceased is co-accused, namely, Sunil Singh.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Garkha P.S. Case no. 269 of 2016.
