Petitioner, who is in custody, seeks bail in connection with Lakhisarai P.S. Case No. 226 of 2017 registered for the offences punishable under Sections 394 of the Indian Penal Code.
Informant has alleged that while he was returning on his pick-up van after unloading goods, one Tata 407 intercepted him and three unidentified persons on the strength of arms overpowered him and snatched away a bag carrying 1,00,000/- and two mobile and also assaulted him and after looting him they fled away with their Tata 407 and thereafter he was carried to hospital were his statement was recorded. The
Patna High Court Cr.Misc. No.68466 of 2018(2) dt.30-11-2018 2/2 name of the petitioner has surfaced in this case on the basis of vehicle number provided by the informant.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has falsely been implicated in this case. He is the owner of the vehicle and runs the vehicle for transportation and carriage. Nothing has been recovered from the possession of the petitioner. He has not been put up on Test Identification Parade. He is in custody since 23.06.2017.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Lakhisarai P.S. Case No. 226 of 2017.
