The petitioner apprehends his arrest in Konch P.S. Case No.41 of 2018 registered under Sections 120(B), 353, 386 and 34 of the Indian Penal Code and under Section 17 of Criminal Law Amendment Act and under Sections 25(1-a), (1aa), 26(2) and 35 of the Arms Act. The police on confidential information about movement of naxalites and putting arms for using against police force raided the place and recovered huge quantity of arms and ammunition.

Learned counsel for the petitioner submits that on mere suspicion the name of petitioner has been figured in the case. Nothing has been recovered from personal possession of the petitioner, but it appears that the petitioner is an active

Patna High Court CR. MISC. No.19906 of 2019(2) dt.01-04-2019 2/2 member of extremist group and he has got criminal antecedent. As many as nine cases of the same and similar nature are pending against the petitioner.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
