The matter has been taken up through video conferencing.
The petitioner seeks bail in Kateya P.S. case No. 83/2020 registered u/s 30(a) of the Bihar Prohibition & Excise Act.
The informant alleged that he got information that one person is coming on a motor cycle from U.P. side and he was carrying liquor. The informant intercepted the motor cycle. The petitioner was apprehended and from the motor cycle of petitioner 106 liters of illicit liquor was recovered. The learned counsel for the petitioner submits that petitioner has falsely been implicated in the case. Somebody else was carrying liquor in sacks and he fell down on the ground
Patna High Court CR. MISC. No.19550 of 2020(2) dt.24-06-2020 2/2 and when petitioner went to save the petitioner has been implicated in the case. The petitioner is in custody since 19.03.2020 and the petitioner has already remained in jail for more than three months.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Gopalganj in connection with Kateya P.S. case No. 83/2020.
