JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 23-11-2016 Heard the counsel for the petitioners and Mr. Abhay Kumar, learned APP for the State.

The petitioners are Bhainsoor (elder brother-in-law) and Gotni (sister-in-law) of the victim and have prayed for bail in Imamganj P.S. Case No. 43 of 2012 registered under section 304B IPC. As per the allegation, the deceased died within a month of her marriage. It appears that information about her critical condition was given to the informant.

It is submitted that general and omnibus allegations against the petitioners have been levelled. It is the prime responsibility of the husband. Considering the same, the mother-

Patna High Court Cr.Misc. No.47802 of 2016 (3) dt.23-11-2016 2/2 in-law of the victim namely Nagya Devi, who was languishing in jail since 08.06.2016, has been granted the privilege of bail vide order dated 16.09.2016 passed in Cr. Misc. No. 37735 of 2016. One another co-accused namely Sintu Prajapati has also been released on bail finding that the accusation against him was general and omnibus, vide order dated 25.06.2015 passed in Cr. Misc. No. 20342 of 2015.

Considering the facts and circumstances of the case, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned SDJM, Sherghati at Gaya in Imamganj P.S. Case No. 43 of 2012 subject to the condition that one of the bailors shall be their own/close family members. They shall appear in person before the court below on each date fixed thereat. In case of default in doing so on two consecutive dates, the court below shall have liberty to cancel their bail bonds and secure their arrest in accordance with law.
