Counsel for the petitioner submits that during pendency of the writ petition, the final order of the departmental proceedings vide Memo No. 51(9) dated 21.01.2021 has been passed and copy of the same has been served in the counter affidavit vide Annexure-A.
In this view of the matter, he seeks permission to
Patna High Court CWJC No.9761 of 2021(5) dt.17-01-2023 2/2 withdraw the present writ petition with a view to seek his legal remedy against the said punishment order by way of filing writ petition.
Liberty aforesaid is hereby granted to withdraw the present case.
In the meantime, the respondent is directed to pay the petitioner the admissible dues within 2 months. With this direction, the writ petition is disposed off with a universal liberty.
