JUSTICE SANJAY PRIYA ORAL ORDER 24-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Aurai P.S. Case No. 02 of 2016 instituted for the offence under Sections 361, 379 and 411 of the Indian Penal Code.

As per the allegation, several articles were stolen from the shop of the informant From the impugned order it appears that during investigation some articles have been recovered from Reshma Devi and she stated before the police that the petitioner had sold those articles to her.

In this manner, besides this there is no any other material against the petitioner in the case diary as also in the impugned order of the learned Sessions Judge. It is mentioned in

Patna High Court Cr.Misc. No.13050 of 2017 (2) dt.24-03-2017 2/2 paragraph-3 of the bail petition that the petitioner has clean antecedent.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Aurai P.S. Case No. 2 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar Tripathi, learned Judicial Magistrate, 1st Class, Muzaffapur, subject to the conditions as laid down under Section 438 (2) Cr.
