Earlier, the bail petition of petitioner was rejected, vide order dated 21.10.2021 passed in Cr.Misc. No. 33396/2021. On last occasion, vide order dated 27.04.2022, a report was called for from the court below regarding stage of the trial, which has been received and kept at flag 'R'. From perusal of the same, it appears that after commitment, only charge has been framed in this case on 07.12.2021 and the case is pending for prosecution evidence.

It is submitted on behalf of the petitioner that petitioner is in custody since 11.02.2021, having no criminal antecedent, and there is no adequate progress in the trial. Considering the period of custody, the prayer for bail of petitioner is allowed. Let the above named petitioner be

No.22123 of 2022(3) dt.29-06-2022 2/2 released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Katihar in connection with Korha P.S. Case No. 492 of 2020, corresponding to S.T. No. 300 of 2021.
