The petitioner apprehends his arrest in Complaint case No. 1598 C/ 2013 for the offence allegedly committed by the petitioner under Section 498A of the Indian Penal Code. The learned counsel for the petitioner submits that petitioner is ready to keep his wife but the learned counsel for the complainant submits that petitioner has already solemnized second marriage and in this view of the fact the complainant is not in a position to live with the petitioner.
Taking into considering the nature of allegation made against the petitioner and the fact that petitioner solemnized
Patna High Court Cr.Misc. No.15614 of 2017 (4) dt.07-07-2017 2/2 second marriage, during subsistence of marriage of petitioner with the complainant, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
