The petitioner seeks regular bail in connection with Araria (Bairgachhi) P.S. Case No. 359 of 2018 for the offences punishable under Section 392 of the Indian Penal Code. The allegation is regarding some miscreants having intercepted the tractor being driven by the driver of the informant loaded with 150 bags of cement. Thereafter, the miscreants are stated to have taken away the tractor and driver along with them, however, subsequently they had released the driver.

The learned counsel for the petitioner submits that the name of the petitioner has transpired in the present case upon confessional statement made by the co-accused namely Md.

Patna High Court CR. MISC. No.19370 of 2019(2) dt.05-04-2019 2/2 Sabettula and Md. Munna. It is further submitted that the petitioner has been falsely implicated in the present case without there being any material to connect the petitioner with the alleged crime and the fact is that the co-accused persons, on whose statement the petitioner has been roped in the present case, have already been granted bail by this Court by a coordinate Bench of this Court vide orders dated 25.2.2019 and 2.11.2018 passed in Cr. Misc. No. 11360 of 2019 and Cr. Misc. No.61991 of 2018. It is submitted that though the petitioner is an accused in one case, but he is on bail in the said case. The petitioner is stated to be languishing in custody since 7.12.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria (Bairgachhi) P.S. Case No. 359 of 2018.
