JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-06-2019 This application, for grant of anticipatory bail, arises out of Bikram P.S. Case No. 148 of 2017, disclosing offences under Sections 307, 325, 323, 341, 504/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner, who is son of the informant is of firing on the informant causing injury to him. Submission of learned counsel for the petitioner is that though there is specific allegation that petitioner fired on head of the informant but no fire arm injury is found on the head of the informant, however, he conceded that there are fire arm injury on the person of the informant..

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the

Patna High Court CR. MISC. No.19503 of 2019(4) dt.24-06-2019 2/2 privilege of anticipatory bail to the petitioner rather petitioner, if so desire, may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
