The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
It is a case of theft of household articles of the informant by the accused persons.
Learned counsel for the petitioners submits that the petitioner has falsely been implicated in this case. He further submits that there is no recovery from the conscious or constructive possession of the petitioner. He further submits that at the instance of the villagers, the name of the petitioner came into light in this case. Petitioner has no criminal antecedent. Learned APP appearing for the State has opposed the
Patna High Court CR. MISC. No.30413 of 2021(3) dt.31-03-2022 2/2 prayer for anticipatory bail.
In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar, District- Katihar in connection with Town Sahayak P.S. Case No. 488 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
