The petitioner is accused in connection with Excise Case No. 08 of 2014/09 of 2014 registered under Sections 47A of the Excise Act pending in the Court of Judicial Magistrate, Ist Class, Samastipur.

Accusation is that in course of raid by the Excise Department, 30 liters of illicit country made liquor kept in a plastic bag were recovered from the shop of the petitioner. Considering the facts and circumstance of the case, I am not inclined to allow the prayer of the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is rejected.
