The petitioner has put to challenge an order dated 22.02.2021 passed by the Sub Divisional Officer, (West), Muzaffarpur, whereby his licence to run a PDS shop under Bihar Targeted Public Distribution System (Control) Order, 2016 {'(Control) Order, 2016' for short}, has been cancelled. It is evident from the pleadings on record that the petitioner has not availed the remedy of appeal against the said

Considering the facts and circumstances, this application is disposed of with a liberty to the petitioner to prefer an appeal against the said impugned order. If an appeal is preferred within four weeks from today, with an application seeking condonation of delay, it is expected that the appellate authority shall not reject the petitioner's appeal on the ground of delay and shall decide the petitioner's appeal on merit within the time stipulated under the (Control) order, 2016.
